Legal Update

Lake Arrowhead Club, Inc. ("LAC") was served with two new civil lawsuits that have been filed in the Superior Court of New Jersey, Chancery Division, challenging LAC's right to collect easement fees from property owners in the community.   A copy of the civil complaints can be found on the Resource Center page of the website.  The Board of Trustees has tendered them to LAC's liability insurance carrier for a full defense, and awaits a determination of coverage from the carrier. 

Be assured that the Board intends to vigorously defend the lawsuits and to seek their prompt dismissal as the suits are regarded as an effort to re-litigate what was previously decided by that Court in a judgment that was never appealed.  While we await a determination on insurance coverage, however, the LAC Board has decided to place on hold planned lake remediation, so that it has a  prudent reserve for legal fees.  We will continue to keep you informed on the status of these two new lawsuits as they progress.
